This Liability Waiver and Release Agreement ("Agreement") is made and entered into by and between the undersigned participant ("Participant") and Vertner's Voyages (collectively referred to as the "Service Providers"), in connection with participation in the pontoon boat experience.

Acknowledgment of Risks

I, the undersigned participant, acknowledge that participation in activities offered by Vertner’s Voyages involves inherent risks, including but not limited to slips, falls, drowning, collision, exposure to weather, and equipment malfunction. I voluntarily assume all risks, whether known or unknown, and accept full responsibility for my participation.

Waiver and Release of Liability

In consideration of being permitted to participate in any activity, I hereby release, waive, discharge, and hold harmless Vertner’s Voyages, its owners, officers, employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may occur during or as a result of my participation.

Health & Fitness to Participate

I certify that I am physically fit and capable of safely participating in boating and related activities provided by Vertner’s Voyages. I have disclosed any relevant medical conditions to the organizers. I authorize emergency medical care if deemed necessary and agree to be responsible for any resulting expenses.

Conduct and Safety

I agree to follow all safety instructions and guidelines provided by the Vertner’s Voyages crew and staff. I understand that failure to comply with safety rules, engaging in unsafe or disruptive behavior, or refusing to follow crew instructions may result in immediate removal from the vessel or termination of the activity without refund.

*Please note, life jackets must be worn prior to entering water but not mandatory while on the boat.

Photography & Media Release (Optional)

I grant permission to Vertner’s Voyages to use photographs or videos taken during the cruise or related activities for promotional or marketing purposes. I may revoke this consent in writing at any time before the event.

Alcohol Policy

If alcohol is served or allowed on Vertner's Voyages:

I confirm that I am 21 years of age or older if I choose to consume alcohol.

I acknowledge that excessive consumption is discouraged and could result in removal from the experience without refund.

Weather or Unforeseen Events

I understand that cruises and other boating activities may be delayed, modified, or cancelled due to lightning, severe weather, mechanical issues, or other conditions beyond the control of Vertner’s Voyages. I waive any claims related to such delays or cancellations. If outing is cancelled prior to sailing due to weather, participant is entitled to a reschedule.

VERTNER’S VOYAGES TOBACCO USE POLICY

Smoking may be allowed in designated areas aboard Vertner’s Voyages pontoon boats. Guests must follow all safety and cleanliness expectations.

I agree to use only the approved ash trays provided when smoking aboard the boat.

I understand that any cigarette burns or damage to seats or other surfaces will result in a repair or cleaning fee charged to me.

I agree to dispose of all smoking-related items properly and help maintain a clean, enjoyable environment for all passengers.

Severability & Governing Law

If any part of this agreement is found unenforceable, the remainder shall remain in effect. This agreement is governed by the laws of the state of Kentucky.

Minors

Participants under 18 years of age must have this form signed by a parent or legal guardian. The guardian assumes full responsibility for the minor’s participation in any Vertner’s Voyages activity.
